Welcome to Konshilah Natural Stone Mall (“we”, “us”, or “Konshilah”). These Terms & Conditions ("Terms") govern your use of our website, products, and services related to natural cladding stone supply, cutting, finishing, delivery and related services. By placing an order or using our services you agree to be bound by these Terms.

1. Definitions

“Customer” means any person, firm or company who purchases or requests a quotation for products or services from Konshilah. “Products” means natural cladding stones, panels, veneers and accessories supplied by Konshilah. “Services” include cutting, finishing, consultation, logistics and installation support.

2. Quotations & Orders

• All quotations are valid for the period stated on the quotation or for 14 days if no period is shown.
• An order is accepted only when confirmed by us in writing (email or order confirmation). We reserve the right to decline any order without assigning a reason.
• Specifications, colours, grain, and texture of natural stone may vary between batches. Samples are indicative and not exact representations of final delivered stone.

3. Prices & Payment

• Prices are as quoted and are exclusive of applicable taxes, duties and delivery charges unless specified otherwise.
• Payment terms will be set out in the invoice. For new customers we may require advance payment or a deposit before dispatch.
• Late payments attract interest at the rate of 1.5% per month or the maximum rate permitted by law, whichever is lower.

4. Delivery & Risk

• Delivery dates are estimates only. We will use reasonable efforts to meet estimated delivery dates but shall not be liable for delays due to circumstances beyond our control.
• Risk in the Products passes to the Customer on delivery to the location specified in the order.
• The Customer is responsible for ensuring safe unloading at delivery. Any charges for re-delivery due to failed unloading will be borne by the Customer.

5. Inspection, Acceptance & Claims

• Customers must inspect all deliveries on receipt and notify us in writing of any shortages, defects, or damage within 48 hours of delivery.
• Failure to provide timely notice is deemed acceptance of the Products and waives the right to reject for visible damage or shortages.
• For accepted claims, our liability is limited to replacement of defective Products or refund of the purchase price (at our option).

6. Returns & Cancellations

• Returns are accepted only with prior written approval and may be subject to handling and restocking charges. Custom-cut or specially finished orders cannot be returned except where defective.
• Order cancellations may be accepted at our discretion and may incur cancellation fees to cover any costs already incurred.

7. Warranty

We warrant that Products supplied will correspond to the agreed specifications at the time of delivery. Natural stone is a natural product and may show variation in colour, veining, and texture — this variation is not a defect. Except as expressly stated in these Terms, all other warranties, whether express or implied, are excluded to the fullest extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by law, Konshilah's liability for any loss or damage arising out of or in connection with the Products or Services is limited to the total amount paid by the Customer for the relevant Products or Services. We are not liable for indirect, special, or consequential losses, including loss of profit, loss of revenue, or loss of opportunity.

9. Intellectual Property

All intellectual property rights in our website content, product images, brochures and materials remain our property or the property of our licensors. Customers may not reproduce or use such material except for placing orders and installation reference for purchased Products.

10. Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control (including but not limited to natural disasters, strikes, transport disruptions, shortages, government actions, or pandemic-related restrictions). In such events we may suspend or cancel performance without liability.

11. Privacy

Any personal information you provide will be handled in accordance with our Privacy Policy. We collect, use and retain information as required to process orders and communicate with Customers. By using our services you consent to such use.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

13. Changes to Terms

We may update these Terms from time to time. The latest version will be posted on our website with the effective date. Continued use of our services after changes indicates acceptance of the amended Terms.
